Terms and Conditions for Vehicle Owners

Definitions

platform refers to the website, mobile application, and customer help line owned and operated by Rofi Car Rentals (Private) Limited.

vehicle owner means the legal owner of the vehicles who list their vehicles for hire on the platform.

hirers means the users of the platform who hire vehicles from vehicle owners through the platform.

vehicles means the vehicles listed by vehicle owners on the platform for hire by hirers through the platform.

we means Rofi Car Rentals (Private) Limited.

you means the vehicle owner or hirer as relevant.

Concierge Fee means the handling fee charged by Rofi Car Rentals (Private) Limited

1. Eligibility: To use this platform as a vehicle owner, you must be at least 18 years old and legally able to enter into a contract. You must also own the vehicle that you are listing for rent on this platform and have the legal right to rent it to others. We reserve the right to inspect the vehicle and review documentation prior to listing the vehicle for hire on the platform and may refuse any listing at our sole discretion.
2. Registration: To advertise your vehicle for rent on this platform, you must register and create an account. You must provide accurate, complete, and current information about yourself and your vehicle(s). You must also choose a username and password to access your account. You are responsible for maintaining the confidentiality of your account and for any activity that occurs under your account.
3. Listing Your Vehicle: You may list your vehicle for rent on this platform by providing information about the make, model, year, and other relevant details about the vehicle. You must also provide accurate pricing information and specify any restrictions on the use of the vehicle, such as a daily mileage, per kilometer charge beyond the specified daily mileage, number of passengers etc. You may also specify any additional fees or charges that may apply.
4. Drivers: You must provide the name and contact information of any driver whose services are offered along with the vehicle listed for hire. The driver must be at least 18 years of age and hold a valid driver's license. The vehicle rental quoted should cover the driver’s wages, accommodation, and meals cost and we bear no responsibility or liability regarding the driver’s wages and allowances. There shall be no employer-employee relationship between us and the driver and you shall indemnify and hold us harmless against any claims, losses, damages and expenses in that regard.
5. Maintenance and Safety: You are responsible for ensuring that your vehicle is in good working condition and meets all applicable safety standards. You must also ensure that the vehicle is clean and presentable for rental. If your vehicle becomes unavailable for rental due to maintenance or repair issues, you must promptly remove it from the platform or update its availability status.
6. Condition of the Vehicle: It shall be your responsibility to ensure that the vehicle conforms to the standards, specifications and condition reflected in the listing and the pictures contained thereon. A hirer is entitled to refuse to accept the vehicle prior to commencement of a trip if it is found, in the opinion of the hirer, that the vehicle does not conform to the standards, specification and condition as per your listing and the pictures contained thereon. Such hirer will be entitled cancel the booking of your vehicle entirely without any liability to you. In such event, the full amount paid by the hirer in respect of your vehicle shall be applied towards such alternative booking through the platform or refunded to the hirer as applicable without any payment being made to you but subject however to other deductions by the platform such as the Concierge Fee. We also reserve the right to remove your listing where it is found that the vehicle does not conform to the standards, specification and condition as per your listing and the pictures contained thereon.
7. Revenue License, Emissions Test and Insurance: You are responsible for maintaining the revenue license, emissions test and full insurance coverage, including rental insurance obtained through this platform, for your vehicle at all times. You must provide proof of compliance upon request. You must also ensure that the insurance coverage is sufficient to cover any damages or losses that may occur during a rental period.
8. Concierge Fee and Payment:
   1. The listing price for each vehicle is the price selected by the owner plus our commission for the time being.
   2. We will collect a Concierge Fee from the hirer at the time of booking request and full payment prior to confirmation of the booking. This full payment will include the commission and any additional fees or charges as determined by us.
   3. We will also collect a security deposit from the hirer prior to confirming the booking. This deposit will be held until the successful completion of the trip, at which point it will be released back to the hirer.
   4. The payment due to you will be released after successful completion of the trip.
   5. We reserve the right to change the Concierge Fee and payment structure at any time. Any changes to the Concierge Fee and payment structure will be communicated to you prior to the changes being implemented.
9. Cancellation Policy: You may cancel a rental booking twenty-four (24) hours before the start time, but you may be subject to fees or penalties in accordance with our cancellation policy which will be communicated to you from time to time. We reserve the right to suspend or remove your listing if you repeatedly refuse to accept bookings or unreasonably cancel bookings after acceptance.
10. No Direct Transactions: You are not permitted to transact directly with hirers outside of the platform. Any attempt to do so may result in the suspension or termination of your account.
11. Indemnification: You agree to indemnify and hold harmless this platform and its affiliates from any claims, damages, or expenses arising from or related to your use of this platform or your rental of your vehicle. This includes any claims related to the condition of your vehicle, the use of your vehicle by renters, or any accidents or incidents that occur during a rental period.
12. Intellectual Property Rights: All content on this platform, including text, graphics, logos, images, and software, is the property of Rofi Car Rentals (Private) Limited or its licensors and is protected by copyright and other intellectual property laws. Any unauthorized use of the content on this platform may violate copyright, trademark, and other intellectual property laws and could result in legal action. You may not, without our express written consent
    1. use any content on this platform for any commercial purpose without;
    2. modify, distribute, transmit, display, publish, sell, license, or create derivative works from any content on this platform;
    3. use any trademark, service mark, or trade name of this platform.
13. Termination: This platform reserves the right to terminate your account at any time and for any reason, without notice. This includes, but is not limited to, violations of these terms and conditions or any inappropriate or illegal activity associated with your use of this platform.
14. Disclaimer: This platform is provided as a service to vehicle owners and hirers. While we strive to provide accurate and reliable information, we cannot guarantee the accuracy, completeness, or timeliness of the information on our platform. You use this platform at your own risk. We do not guarantee that the platform will be available at all times or that it will be free from errors or interruptions. We are not responsible for any loss or damage that may result from your use of this platform.
15. Relationship: This platform (Rofi Car Rentals (Private) Limited) is not a party to any rental agreements made between vehicle owners and hirers. We are not responsible for any disputes that may arise between vehicle owners and hirers. We do not endorse any vehicle owners or hirers on this platform. We do not guarantee the safety or reliability of any vehicle advertised on this platform. It is your responsibility to determine the suitability of a vehicle and the trustworthiness of a vehicle owner or hirer before entering into a rental agreement. We are not responsible for the actions of any vehicle owners or hirers on this platform. You agree to indemnify and hold harmless this platform and its affiliates from any claims, damages, or expenses arising from or related to your use of this platform or your interactions with other users.
16. Changes to These Terms: These terms may be updated from time to time. It is your responsibility to review these terms regularly and to ensure that you are in compliance with them. Your continued use of this platform after any changes have been made constitutes your acceptance of the revised terms.
