Terms and Conditions for Hirers

Definitions

platform refers to the website, mobile application, and customer help line owned and operated by Rofi Car Rentals (Private) Limited.

vehicle owner means the legal owner of the vehicles who list their vehicles for hire on the platform.

hirers means the users of the platform who hire vehicles from vehicle owners through the platform.

vehicles means the vehicles listed by vehicle owners on the platform for hire by hirers through the platform.

we means Rofi Car Rentals (Private) Limited.

you means the vehicle owner or hirer as relevant.

Concierge Fee means the handling fee charged by Rofi Car Rentals (Private) Limited

1. Eligibility: To use this platform as a hirer, you must be at least 18 years old and legally able to enter into a contract. You must also have a valid driver's license.
2. Registration: To hire a vehicle on this platform, you must register and create an account. You must provide accurate, complete, and current information about yourself. You must also choose a username and password to access your account. You are responsible for maintaining the confidentiality of your account and for any activity that occurs under your account.
3. Hiring a Vehicle: To hire a vehicle on this platform, you must select a vehicle from the available listings and complete the booking process. You must agree to the terms and conditions set by the vehicle owner, including any restrictions on the use of the vehicle and the cancellation policy. You must also provide any required documentation, such as a valid driver's license.
4. Trip Commencement and Conclusion: To commence a trip, you will be required to show the QR Code generated through the platform to the vehicle owner and a trip is deemed to commence upon that code being scanned by the vehicle owner through the platform. At the conclusion of the trip you are required to scan the QR code of the vehicle owner through the platform.
5. Fault Reporting and Alternative Vehicles: If the condition of the vehicle is materially different to the listing on our platform, it is your responsibility to report such faults to our customer support team prior to commencing the trip. As soon as reasonably possible thereafter and without any guarantee whatsoever, we will endeavor to offer a vehicle equal to or better than the vehicle booked by you as per the listing. If you select an alternative vehicle, we will set off payments made for the vehicle originally booked to the alternative booking and if there is an excess amount, this will be refunded to you. If the rental cost for the alternative vehicle is higher, you will be required to pay the difference. In the event that you do not wish to select and alternative vehicle or we are unable to offer such alternative vehicle, you will be entitled to a refund of the payment made by you, together with the refundable security deposit, after deducting our Concierge Fee.
6. Return Policy: You are required to return the vehicle to the owner on the date and time and at the return location specified in your booking confirmation. There shall be no discount or refund for early returns. Failure to comply with the return policy and scan the owner’s QR Code to conclude the trip will incur a per day charge for every delayed day (or part thereof) as well as an additional fifty percent (50%) of the per day charge as liquidated damages and not as a penalty (together “Late Return Charges”). The platform is entitled to apply the security deposit towards these charges and any shortfall will be claimed from you. There shall be no option to extend bookings. However, based on availability, a fresh booking for the same vehicle may be made through the platform as necessary.
7. Concierge Fee and Payment:
   1. You must pay a Concierge Fee when placing the booking request and will be prompted to make full payment together with a refundable security deposit upon the booking being confirmed. A booking is confirmed only once such full payment is made together with the deposit.
   2. This deposit will be held until the successful completion of the trip, at which point it will be released back to you within three (3) working days subject to Clause 5 above and in the event that the vehicle is damaged during the rental period, we shall apply the security deposit toward rectification of defects and release the balance, if any, to you. In the event that any additional fees or charges are payable by you under these terms and conditions (e.g. Late Return Charges), we shall apply the security deposit towards these payments and release the balance, if any, to you. If the security deposit is insufficient to cover such damages or additional fees or charges, an additional payment will be claimed from you.
   3. You must pay for the rental of the vehicle through this platform, using a valid payment method. You are responsible for any fees or charges associated with your payment method.
   4. The payment for the rental will be processed at the time of booking confirmation and is non-refundable, except in accordance with the cancellation policy set by the vehicle owner.
8. Maintenance and Safety: You are responsible for returning the vehicle in the same condition as it was provided to you. During the trip you shall be responsible for routine checks of the vehicle in accordance general practice and in response to warning signals, including regular checking of oil, water, coolant, spare wheel, and air-pressure of tires. You shall not remove or replace any of the vehicle’s parts or change its condition in any manner without prior approval from us. You must also follow all applicable traffic laws and safety regulations while driving the vehicle. You shall be solely responsible for the safety and security of the vehicle during a trip and you shall not leave the vehicle unattended or abandoned. You must familiarize yourself with the safety and security systems applicable to the vehicle hired by you. If you experience any issues with the vehicle during the rental period, you must promptly notify us through our customer help line on this platform. In case of any accidents, it shall be your responsibility to notify the relevant insurance provider and us immediately.
9. Indemnification: You agree to indemnify and hold harmless this platform and its affiliates from any claims, damages, or expenses arising from or related to your use of this platform or your rental of a vehicle. This includes any claims related to the condition of the vehicle, the use of the vehicle by you, or any accidents or incidents that occur during the rental period.
10. Intellectual Property Rights: All content on this platform, including text, graphics, logos, images, and software, is the property of Rofi Car Rentals (Private) Limited or its licensors and is protected by copyright and other intellectual property laws. Any unauthorized use of the content on this platform may violate copyright, trademark, and other intellectual property laws and could result in legal action. You may not, without our express written consent
    1. use any content on this platform for any commercial purpose without;
    2. modify, distribute, transmit, display, publish, sell, license, or create derivative works from any content on this platform;
    3. use any trademark, service mark, or trade name of this platform.
11. Termination: This platform reserves the right to terminate your account at any time and for any reason, without notice. This includes, but is not limited to, violations of these terms and conditions or any inappropriate or illegal activity associated with your use of this platform.
12. Disclaimer: This platform is provided as a service to vehicle owners and hirers. While we strive to provide accurate and reliable information, we cannot guarantee the accuracy, completeness, or timeliness of the information on our platform. You use this platform at your own risk. We do not guarantee that the platform will be available at all times or that it will be free from errors or interruptions. We are not responsible for any loss or damage that may result from your use of this platform.
13. Relationship: This platform (Rofi Car Rentals (Private) Limited) is not a party to any rental agreements made between vehicle owners and hirers. We are not responsible for any disputes that may arise between vehicle owners and hirers. We do not endorse any vehicle owners or hirers on this platform. We do not guarantee the safety or reliability of any vehicle advertised on this platform. It is your responsibility to determine the suitability of a vehicle and the trustworthiness of a vehicle owner or hirer before entering into a rental agreement. We are not responsible for the actions of any vehicle owners or hirers on this platform. You agree to indemnify and hold harmless this platform and its affiliates from any claims, damages, or expenses arising from or related to your use of this platform or your interactions with other users.
14. Changes to These Terms: These terms may be updated from time to time. It is your responsibility to review these terms regularly and to ensure that you are in compliance with them. Your continued use of this platform after any changes have been made constitutes your acceptance of the revised terms.
